Terms and Conditions of Use and Privacy Policy

Subject

The site, available at https://alumni.ubfc.fr/, is a private professional social network made available by University Bourgogne Franche-Comté, to enable its members (students and graduates of UBFC masters, PhD students, doctors, recruiters, friends of the network) to help each other, keep in touch, facilitate networking, share opportunities, exchange advice, enhance training, promote professional integration, employment and career. The site and its services are provided by the "AlumnForce" application published by MEVIA, a simplified joint stock company with a capital of €11,300, registered with the Nanterre Trade and Companies Register under number B 501 609 143, whose registered office is located at 93-97 rue Eugène Caron, 92400 Courbevoie, France.

The purpose of these general terms and conditions of use is to govern access to and use of the Site. We invite you to read them carefully.

By activating your Account, applying for an Account, making a reservation at an event or making a purchase on the Site, you acknowledge that you have read and accept these terms and conditions in full.

Definitions

  • Terms beginning with a capital letter in the GCU have the following meaning (unless expressly stated otherwise): Site refers to the website of the "UBFC Alumni" network of the University Bourgogne Franche-Comté community accessible at the address https://alumni.ubfc.fr/ giving access to the Network Services ;
  • Users are members who can access the services via an Account (students and graduates of UBFC masters, PhD students, doctors, recruiters, friends of the network), individuals registering for an event and Administrators. For each type of User, access to the services may be limited according to the choices of the Administrators.
  • Administrators are natural persons employed or not by University Bourgogne Franche-Comté and authorized to use for professional or management purposes the Modules of the AlumnForce application: they have access to an Account allowing them to configure the Modules and to configure or carry out actions on the User Accounts;
  • Account means a valid account giving access to the Services of the site;
  • Content means any content that Users can download and access from the site, including but not limited to articles, events, directories, profile files with Personal Data according to the confidentiality that each User has configured from his preferences;
  • Personal Data means any personal data relating to a natural person who is or could be identified;
  • Modules are applications for managing a private professional social network developed by AlumnForce and accessible as « software as a service» (SaaS);
  • Privacy Policy means the document drawn up by University Bourgogne Franche-Comté presenting its processing of Users' Personal Data and defining their corresponding rights;
  • Services refers to the supply of the Modules and the additional services that can be provided on request by AlumnForce to University Bourgogne Franche-Comté, including configuration, assistance or training, etc.;

Scope of the General Terms of Use

These general terms and conditions of use ("GTCU") are applicable to all use and access to the Site Services. They are validated electronically by the User at the time of the activation of his Account and at each modification of the GCU. The TOS are accessible at any time on the Site. The professional social network is not freely accessible. Access is restricted to network Users who have accepted the TOS and have an Account with a login and password.

Users acknowledge that they have read and understood the TOS and agree to be bound by them.

University Bourgogne Franche-Comté reserves the right to modify the TOS at any time by notifying by email any new version to the Users, who undertake to take note of these modifications.

Description of the services provided by University Bourgogne Franche-Comté

University Bourgogne Franche-Comté offers its members the following services:

  • A participatory network information and sharing service (news, events, discussions, newsletters, wall activities, comments, internal messaging, notifications, sharing to social networks, etc.).
  • A directory of User members with access to User profiles
  • A service to put users in touch with each other via an internal messaging system.
  • A job offer service
  • A Participatory Group Service
  • A ticketing service for paying events
  • A service of good plans, projects, and announcements
  • A mentoring sponsorship service

 All these services aim to bring together the people of the University Bourgogne Franche-Comté to encourage contacts, mutual aid, professional integration and career development.

Access to services

The User of the site acknowledges having the necessary skills and means to access this site and having verified that the computer configuration used does not contain any viruses and that it is in perfect working order.

To benefit from access to the network, the User must be a graduate, student of the University Bourgogne Franche-Comté and have an active e-mail address to activate his account and participate in the network. His Account must have been created beforehand by an Administrator.

Anonymous visitors can access the site, view public articles and events, but cannot visit profiles, post comments or participate in discussions. They may have access to registration for events open to the public. In this case they will have to accept the TOS to book their participation in such events and provide at least their first name, last name and an active email.

Users such as recruiters or representatives of a partner company will be able to join the network with restricted access to post job offers, access the profile directory, CV database, candidate alert. These Accounts will have to be validated or created beforehand by an Administrator.

Users of friends type of the network (people interested and relevant to the network (e.g. teacher-researchers, associations), will be able to join the network taking advantage of certain tools made available to them in order to join the community, publish information, animate or join a group . These Accounts will have to be validated or created beforehand by an Administrator.

The User undertakes not to use a pseudonym or e-mail address that could infringe the rights of third parties (surname, trademark, etc.), nor to usurp a name, company name or registered trademark.

At his first connection, the User will have to accept and validate the TOS, specify his password and update his Account preferences with respect to notifications and confidentiality levels of his profile information. His Account may be deactivated and then deleted if it remains inactive for more than two years, by an Administrator.

Directors

The Administrators declare that they are authorized to use the Services and have accepted the TOS on behalf of University Bourgogne Franche-Comté. The Administrator sets the configuration of the User Accounts via imports or individual additions.

 He configures and validates the access requests of Users such as representatives of partner companies. The Administrator can send the accesses to each User. The Administrator can block access to a User if necessary.

User Accounts

The User will be able to access the Services once the TOS have been validated and only if the User's Account has been previously created by an Administrator with at least a First Name, a Last Name and an active E-mail. The User will need to provide at least one active e-mail and specify the password to identify himself/herself at the first login. He will be able to modify and update his e-mail and password at any time since the management of his Account. He will then access his User menu to access the different Modules of the platform in correspondence with the accesses authorized according to his type of User.

Password

The password associated with each Account is strictly personal and confidential and must not be shared with third parties. Users are responsible for the loss or theft of their password. We recommend that Users constantly change their passwords and choose complex passwords of at least 8 characters including specific letters, numbers and characters. Each User is free to change their password at any time from the management of their Account.

Use of services

The texts, software, images, videos, data and any other work on this site are protected by the code of intellectual property. The User of the site undertakes not to reproduce them without the express consent of University Bourgogne Franche-Comté. The User undertakes not to copy or sell all or part of the Modules and the Site.

The User guarantees to University Bourgogne Franche-Comté that he has the necessary rights, including all intellectual property rights on the articles, testimonials, comments, images and data of any kind that he discloses on this Site, allowing him to grant the rights transmitted here in.

The User expressly consents, free of charge, to the reproduction and/or representation of his comments and testimonials in the communication media intended for the promotion of UBFC Alumni for the entire legal period of protection of these comments and testimonials.

Posted messages and images are under the responsibility of their author, who undertakes to assume all responsibility and the consequences thereof. In particular, the author of the message guarantees University Bourgogne Franche-Comté against all actions taken by third parties and having for cause, foundation or origin the content of his message. He therefore undertakes to pay the amount of the sentences and related defence costs, or any transactional indemnity that may be due in the context of the dispute. The representatives of the site decline all responsibility for the content of messages posted by users.

The User is responsible for the Account assigned to him/her from the date of its activation. It is his or her duty to keep his or her Account secret and not to disclose it to any other person. The User is solely responsible for the use that is made of his/her Account, as well as the Content published via his/her Account.

For the respect and the good of all, the following are prohibited: messages of an insulting, offensive, obscene or defamatory nature, content violating the rights of others, violent comments or inciting to racism, pornography, paedophilia or crimes and offences, hijacking of the site for propaganda, commercial prospecting or political purposes.

Users can report any disturbing messages to the Administrator. The Administrator may delete without notice any message that does not comply with the above conditions. University Bourgogne Franche-Comté reserves the right, without justification, to deny access to the Site to any Visitor or User who has not respected the present conditions of use or the applicable law. If, according to the Visitor or User concerned, this is an error, the latter may contact University Bourgogne Franche-Comté.

Group Participation

The Site allows Users, if the Groups Module is active, to create restricted circles within the network. They can organize themselves into groups, for example around a city or a region or a professional theme. The members of each group can thus have access to articles, events, forums, media, a directory specific to their group. Each group and its members must comply with the provisions of these T&Cs.

Submission of job offers

All Users of the Site who may submit a job offer undertake not to use prohibited or discriminatory criteria, including the following criteria: origin, sex, morals, sexual orientation or identity, age, marital status or pregnancy, genetic characteristics, membership or non-membership, true or supposed, of an ethnic group, nation or race, political opinions, trade union or mutualist activities, religious beliefs, physical appearance, etc. (Art. L 1132-1, L 1142-1, L 5531-2 of the French Labour Code).

Personal data protection and privacy policies

The person responsible for processing the personal data referred up to here is University Bourgogne Franche-Comté.

The data, initially integrated, concerning the Users in the Site come from University Bourgogne Franche-Comté. These data are necessary to obtain an Account and access to the services. It is at least First Name, Last Name, E-mail, and academic courses.

The other data are optionally updated by Users themselves from their profile in order to present their expertise and projects to other Users for the purpose of interaction and to create opportunities for exchanges, networking and to generate statistics on professional mobility:

  • Profile picture
  • Presentation
  • Personal details (telephone, mobile, personal e-mail(s), primary and secondary address), date of birth, marital name, family status
  • Current employment and professional contact information (position, typical function, company, typical sector, etc.).
  • Previous employment(s)
  • Current situation and professional wishes
  • Skills acquired and languages practiced
  • Further training courses
  • Associative activities and interests
  • Curriculum vitae (via file uploaded or generated from previous information)

The identity of Users is publicly visible only if the User has activated his public profile or Public CV. Each User is free to activate or desactivate their public profile at any time.

The identity of Users (First Name, Last Name, Photo, City, Country, Position, Company) is visible to other Users from the Directory (list and map view) and from any interaction on the professional social network through an activity or participation by the User in an article, event, comment, group or discussion.

The information collected from Network Users through their profile and form can only be consulted by other Network Users (students and graduates of UBFC Masters, PhD students, PhDs, authorized recruiters, friends of the Administrators network). Users can limit access to their profile information according to the type of User by managing their confidentiality.

 Users of type Recruiters or persons representing a partner company provide the following data for the creation of an Account:

  • Civil status, First name, Last name, E-mail, Position in the company
  • Company name and company address

Visitors from outside the network who register for an event will have to provide the following minimum data:

  • First name, Last name, E-mail

and depending on certain events the following data:

  • Address, Telephone, Mobile, Date of birth, Current position, Company, Business address, Business e-mail

When making a payment for a service on the Site (event ticket, membership, donation or subscription), we will ask you to provide shipping and billing address information to create an order and associated receipt. We do not store any credit card or bank details; this information is processed by our online payment processing provider.

When you use the Site, we automatically collect information, including personal information, about the services you use and how you use them. This information is necessary for the proper execution of the agreement between you and UBFC, for us to comply with legal obligations and given our legitimate interest in being able to provide and improve the functionality of the Site:

  • Geolocation information: when you use certain features of the Site, we may collect information about your location, through your IP address or through the GPS of your mobile device, in order to provide you with a better user experience. Most mobile devices allow you to control or disable the use of location-based services in applications from the device settings menu.
  • Usage Information: The AlumnForce provider collects information about your interactions on the Site, such as your page or content views, searches, purchases you have made (if enabled) and other actions on the Site to improve the Site Services.
  • Login and Device Data: We automatically collect Login and Device Data when you access the Site. This information includes, but is not limited to: information about how you have used the Site, IP address, access dates and times, computer hardware and software data, device data, data associated with device use, unique identifiers, crash data, cookies. This information allows us to improve the performance of the Site and the quality of the Services, and to detect and prevent fraud, spam, abuse, security incidents and other harmful activities.

Users agree to always provide truthful and sincere Personal Data and to update them if necessary to keep them complete and accurate. We will repeatedly ask you to do so.

The information of a User contained in the database of the professional network remains the property of this User. In accordance with the European regulations in force, the Users of the Site have the following rights:

  • right of access (article 15 RGPD) and rectification (article 16 RGPD), updating, completion of Users' data
  • right to erase Users' personal data (Article 17 of the DPMR),
  • right to withdraw consent at any time (article 13-2c GDMP)
  • right to limit the processing of Users' data (Article 18 DPMR)
  • right to object to the processing of Users' data (Article 21 RGPD)
  • right to portability of the data provided by Users (Article 20 DPMR)

Any Network User may freely modify or delete information that he has entered himself on the network. He can also demand that the information concerning him provided by University Bourgogne Franche-Comté be rectified, completed, clarified, updated or deleted. No personal information is collected without the knowledge of network members.

You may exercise this right:

  • by modifying your information from the management of your Account, in the "My Profile" section.

University Bourgogne Franche-Comté is the only one authorized to hold the data and undertakes not to resell or transmit them to third parties, and that this information will not be processed for any other purpose than to put it online within the Site. University Bourgogne Franche-Comté may process your personal data in the context of your access and/or use of the Site. This includes data that is collected by University Bourgogne Franche-Comté when a User activates his Account or updates information on the User's profile.

However, the quantitative elements concerning the employability of master and doctoral graduates may be transmitted to the training service and doctoral schools required to inform their students and doctoral students of the conditions of professional integration in their scientific disciplines.

The UBFC Alumni Site is protected by the provisions of the Intellectual Property Code, on the protection of databases. Any person who would constitute a file or a database with the information present on the UBFC Alumni Site, and who would make it available to a third party, for a fee or free of charge, without the agreement of University Bourgogne Franche-Comté and in violation of the Terms of Use, would be subject to civil and/or criminal penalties provided by the Code of Intellectual Property.

University Bourgogne Franche-Comté reserves the right to make changes to this Privacy Policy to comply with changes in the laws and regulations in force. The changes made will be notified via our Site or by email, whenever possible, at least thirty days before they come into force.

Data retention period

We keep your data only if it is required for the purposes for which it was collected, in accordance with the legal requirements.

Security

Users of the Site acknowledge that they are aware of the risks associated with the use of the Internet and networks, and of the fact that information relating to personal data concerning them may be copied or intercepted. The User of the Site acknowledges accepting these risks, for which University Bourgogne Franche-Comté can in no way be held responsible. University Bourgogne Franche-Comté, for its part, implements all technical and human resources to ensure a permanent level of security in accordance with the rules of art in force in this field and to prevent attacks by malicious persons. Some of the protective measures we use to protect your information are firewalls and encrypted data transmission using SSL/HTTPS technology.


Warranty 

University Bourgogne Franche-Comté undertakes to take particular care regarding the veracity of the information exchanged on the Site and to keep it regularly updated. However, errors or omissions may be found. In this case, we would be grateful if you would inform us of them so that we can make the necessary corrections. During its checks and occasional interventions, the Site Administrator undertakes not to modify the Contents in a way that could change their meaning. However, he reserves the right to move the Contents if he notices a flagrant error in the thematic classification.

University Bourgogne Franche-Comté does not guarantee uninterrupted access to the Site, in particular in the event of interventions for maintenance, repairs, or disruptions to internet connections. It cannot be held responsible for technical failures and loss of related data, nor for any other indirect damage occurring during or related to the use of the site.

Applicable law

The TOS are governed by French law alone. Any dispute arising from the validity, interpretation and/or execution, termination, breach, of these Terms and Conditions and after failure of any conciliation, will be submitted to the competent court.
